NZ Landlord Documentation Framework

Landlord Due Diligence Centre™

A practical five-step framework to help New Zealand landlords and property managers build a documented evidence base — pre-tenancy testing, inspection records, prevention measures, and exit screening.

Can You Prove You Managed the Risk?

Landlords and property managers increasingly need to demonstrate that they took reasonable steps to understand and manage property risk. That means documentation — not just good intentions. A pre-tenancy baseline test, a consistent inspection record, and a documented prevention approach create an evidence base that protects you when questions arise.

The Due Diligence Centre™ is not a compliance framework. It is a practical resource to help you understand what due diligence looks like and what documentation supports it.

Five-Step Framework

The Due Diligence Framework™

01

Baseline Screening

Before a tenancy begins, a baseline screening assessment establishes a documented, verifiable record of the property's condition. This is the starting point of your due diligence record.

Pre-tenancy meth screening completed
Result documented and filed
Date and testing company recorded
Result communicated as part of tenancy documentation
02

Tenancy Documentation

The tenancy agreement and associated documentation create the legal and practical framework for the tenancy. Due diligence includes ensuring this documentation is complete and appropriate.

Property condition report completed at commencement
Tenancy agreement includes relevant contamination clauses
Tenant awareness of contamination obligations documented
Pre-tenancy inspection records filed
03

Regular Inspection Records

Consistent inspection records — completed regularly and documented in detail — create the longitudinal property history that supports informed decision making and due diligence.

Inspection schedule maintained and adhered to
Inspection observations documented in writing
Any unusual findings recorded with photographs
Inspection records stored and accessible
04

Prevention Measures

Proactive prevention measures — including visible deterrence, tenant awareness, and systematic property management — form part of a documented due diligence approach.

MethShield® or equivalent deterrence system in place
Tenant awareness of contamination consequences documented
Visible signage in place where appropriate
Prevention measures recorded as part of property file
05

Exit Screening

End-of-tenancy screening allows comparison against the pre-tenancy baseline, providing the most comprehensive picture of what occurred during the tenancy.

End-of-tenancy meth screening completed
Result compared against pre-tenancy baseline
Any findings documented and actioned appropriately
Post-tenancy condition report completed

Proactive Access Control: Ceiling Cavity Restriction

Limiting access to ceiling cavities is a general best practice that protects occupants and supports your due diligence position. If contamination is discovered, restricted access demonstrates proactive management and helps contain exposure:

  • Restrict access to ceiling cavities using lock-out tags on hatches and access points
  • Prevent unauthorised entry to cavities by securing hatches and openings
  • If contamination is discovered, restricted access demonstrates informed property management
  • Document all access restrictions with dates and photographs as part of your property file
  • Brief occupants and maintenance staff on cavity access restrictions and the reasons for them

Why Documentation Matters More Than You Think

The absence of documentation doesn't just create an information gap — it creates an evidentiary gap. When a contamination dispute arises, when an insurance claim is lodged, when a tenant or new owner raises questions about property history, what you can demonstrate matters significantly more than what you remember.

Buried Truth documents multiple cases where property owners could not establish their own position because no records existed. Due diligence documentation is not bureaucracy. It is your evidence.

The Due Diligence Centre™ is an informational resource only. Nothing here constitutes legal, insurance, tenancy, or professional advice. All documentation practices should be developed in accordance with applicable New Zealand legislation and in consultation with qualified professionals where appropriate.
